Terms of Service Agreement

(Effective Date March  20, 2025)

These general terms and conditions apply to Nouview's (hereinafter referred to as “app”) contractual relationship with you, the user about to sign up for an account on this app. The app is designed to assist foreigners, tourists, immigrants, and disadvantaged ones in planning before immigrating, traveling, or living in a designated area where they may go to. The app aims to create reliable social support through the mentor network on the app in the planning phase. By using the app, you must follow the app’s Terms of Service Agreement and accept that the app can suspend your account if you violate any of the items below:

Content of Agreement

  1. While using the app, you agree to conduct yourself with goodwill and respect the app’s community rules
      1. You understand it is your choice to be only a mentee or further sign up for a mentor that aims to help other users understand the neighborhood, the township, or the city where you reside 
      2. You will not use any improper or rude language or be disrespectful to other users
      3. You will use a valid name and profile when interacting with other users
      4. You will not spam other users, and be responsible for legal consequences by the local laws where you reside 
      5. You will not violate the privacy of other users by misusing the information given by the app
      6. You will not provide illegal and inappropriate information or guidance to other users 
      7. You will not use this as a dating platform and harass other users
      8. You agree, that once signing up as a mentor on the app, you will not be able to reverse this status
      9. You agree to be responsible for your mentoring service with a reasonable price (hourly rate) that does not go above USD 150
  2. The app gives you access to an online database, through which you can get to know other registered users in the services that are either free or subjected to a fee if applicable. The app’s services are available via mobile apps for IOS or Android mobile devices, as well as web pages from a station, such as a laptop or a desktop, when sharing/accessing a user’s profile. You agree not to illegally retrieve data/information from the database using the tools at your disposal.
    1. The online database provided by the app contains so-called profiles, which the registered users fill with photos and other self-disclosed information. The app intends to have data protection based on GDPR, CCPA, PIPEDA, and APPI principles and guidance; such intention cannot guarantee meeting all of their compliance standards simultaneously, while rules in each may have conflicts.
    2. With the app, registered users can contact each other for mentoring through a one-on-one video session. You are responsible for booking, scheduling, or showing your availability. The app will not guarantee a successfully booked session every time. 
  3. By using the app, you understand that any profit and its taxation liability are not the app’s responsibility but yours.
  4. This agreement will always remain in full force while you are registered on the app. You can delete your account anytime and for any reason by following the instructions in the “Delete Account” option on the app. You agree the app can end or suspend your account at any time without prior notice based on any suspicious activities or business reasons. All terms in this agreement will survive termination and continue in full force and effect.

Conclusion of the Contract

  1. The use of the app services requires your registration. The prerequisite for this is an email address, a password selected by the user. Other log-in options are available, depending on your location and device. Please understand that the registration is only successfully submitted when these terms have been read and agreed upon.
  2. The app also requires a valid phone number to register on the app. To proceed with the sign-up process, you agree that the app is allowed to send text messages (SMS) to continue the registration. It’s the customer’s responsibility to make sure to read the consent.
  3. After registration, you should complete your profile with the required pictures and information. Please note that the app has the right to terminate your account at any time, in particular, if you are in violation of these terms of service or are deemed as “high-risk,” possibly endangering other users or not a fit for our platform as described below:
    1. Sugar Baby/Sugar Daddy Accounts- Looking for any kind of arrangement is not allowed on the app in any form, which includes asking to be ‘spoiled’ or treated like a ‘Queen,’ ‘King,’ ‘Prince,’ or ‘Princess.’ We have the right to remove any account we feel is searching for an arrangement not limited to these words, but any word, abbreviation, or emoji we feel is implying this.
    2. Scammers and Fraud- Any user asking for payment or reimbursement from another user with flawed mentorship violates these terms. Any users partaking in illicit behavior will be immediately banned when brought to attention. We have the right to review any messages sent using the app if we believe any behavior of this nature has taken place. 
    3. Nudity, Explicit Content, and Violence- Any nudity, explicit, or overly sexual content on your profile can result in it being banned at our discretion. Any unwanted sexual or explicit content in private messages can also get you banned if there is any evidence that it is unwarranted. This includes sending any explicit content without prior approval of the other party. Adding links in your bio or personal messages to other members containing explicit content or nudity without prior consent will also result in the termination of a profile. Please don’t include your sexual desires on your profile; keep it classy. Showcasing violence in your profile text or pictures is not allowed on the app, which contains images that display violent scenes, such as with guns, firearms, knives, and other weapons. Please note that hunting pictures also fall into this category. Treat people nicely, and you will get the most out of the app.
    4. Poor Quality Account- The app is a high-quality platform for users. If a profile does not meet these standards, we have every right to remove your account.
    5. Harassment and Spam- The app will ban any user who harasses others. Spam can also result in this, for example, messaging multiple users with the same content repeatedly, asking users to visit other sites, or messages that are not understandable.
    6. Hate or Political Content- The app can ban accounts associated with hate speech or derogatory comments to any other user, no matter the circumstances. Please report any hate speech immediately if you experience this and do not respond to the other user. We will investigate the matter. By engaging in hate speech yourself, you are at risk of having your profile removed, too.
    7. The app is an inclusive environment, and we hope you keep your political opinions away from your public profile. Love, openness, and diversity cross the political and human spectrum, so who you support doesn’t matter. Concentrate on who you are as a person, and you will find others who seek or are being sought as a mentor.
    8. Fake Profiles- The app can ban and remove any profile we suspect to be fake, a copy of another person, or a recreation of a previously deleted profile.
    9. Phony Dating or Adultery- The app is a platform for anyone to find local mentors based on the mentoring field categories set up by them. We don’t tolerate the use of our app for affair dating, adultery, cheating, swinging, and any other kinds of sexual-related purposes or non-genuine connecting. If you are married or in a relationship, you cannot use the app for your dating needs. Keep it real and clean to build on our great community.
    10. Abusive Messages or Behavior- Any threats of violence or abuse of any kind are strictly prohibited. We don’t tolerate this in the slightest. If it has been reported to us, we may ban any account temporarily or permanently at our discretion. Impersonation of other accounts or people and threats made ‘sarcastically’ are also not allowed. Mentions of self-harm, suicide, terrorism, coercion, or any other violent content will result in the permanent ban of your profile.
  4. Reviews- After each mentoring session, the mentor and the mentee will have an opportunity to review each other. The review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our Content Policy or Review Policy. The app does not verify reviews for its accuracy. If you have concerns, it is your responsibility to report the review with relevant evidence for any dispute.

Liability Limitation

  1. We are not responsible for incorrect information within our users’ registration or profile information. We can, therefore, not guarantee the accuracy of the compatibility between matches.
  2. We don’t guarantee any success in mediation. The app only provides you with IT services or technical infrastructure to automatically mediate contacts.
  3. If you misuse the app’s services in an unauthorized or illegal manner, the app assumes no liability. The app cannot be held responsible for information misuse, especially if you have made the information accessible to a third party.
  4. The app further accepts no liability if you misuse it unlawfully or illegally, particularly if you have made the information accessible to others or shared information in a private chat.
  5. For any consequences resulting from events in which you have come to harm in any way or are subject to financial losses, the app accepts no liability. This is especially the case in events where you have been warned not to share personal information with the other party or move outside of the app for further interaction.
  6. The app does not guarantee uninterrupted operation or the correct use or accessibility of the service at any time. In particular, the app is not liable if disruptions are due to force majeure or events beyond the app’s sphere of influence. In addition, the app is not liable if third parties gain unauthorized knowledge of your data (e.g. through a "hacking attack”).

Functionality

  1. To fully use the product, you must use or enable the use of the latest common technologies on your device or the current Android or iOS app version. If older or not commonly used versions or technologies are used, you may have limited use of the product.
  2. If we provide you with product updates, including updates for our Android and iOS apps, we strongly recommend that you install them as soon as possible. It is your responsibility to install such updates within a reasonable time. If you fail to do so, even though we have advised you of the availability of the update and the consequences of not installing it, we will not be liable for any product defects resulting from your failure to install the update. 

Customer's Duties

  1. The use of the app services forbids any use of the app that violates any legal law, code of ethics, and good citizen behavior. This includes but is not limited to crimes, fraud, escorting, prostitution, and human trafficking.
  2. The customer is obliged to make all payments due to the app on time by providing valid payment information.
  3. When registering, it is your responsibility to provide truthful information. You are solely responsible for the content of your data and assure the accuracy of the information. The app reserves the right to take civil action against customers who intentionally and/or fraudulently provide false information.
  4. The app’s services are intended for private use only. By registering, you undertake not to use the app’s services for commercial purposes and not to use data made available for commercial or advertising purposes. You are not permitted to systematically collect other users' content (e.g., through a special program or by simply copying the data) and to use it for purposes other than the service of the app. In this context, it is particularly not permitted to use computer programs such as Crawlers to read data on the app.
  5. If you acted culpably, you are obliged to indemnify the app against any lawsuits, damages, losses, or claims that could arise from your registration and/or participation in our service. This applies in particular to damage due to defamation, insult, violation of personal rights, the loss of services for other customers, a violation of these terms and conditions, the violation of intellectual property or other rights. The amount of the claim for reimbursement of expenses is limited to the expenditure required or required for a specific purpose.
  6. It is your responsibility to keep messages from other app users confidential and not to make them accessible to third parties without the consent of their author. The same applies to the names, telephone numbers, email and residential addresses, social media profiles and/or URLs or other personal data, etc., of our customers.
  7. You are required to respect the information shared by other users publicly or in personal chats. This means you are forbidden to screenshot personal profiles and messages or record video chats to share them with anyone else except the app’s customer service. It is also forbidden to share personal information, such as social media accounts, that you were about to learn via personal messages without the other person's consent. When using chat features on third-party apps, you are required to behave respectfully and politely.
  8. You are not allowed to share a social media account or phone number in personal chats that are not under your control or that do not belong to you. Misuse of this service will be prosecuted. What you are not obliged to do is listed in 10, and the consequences if you do so can be found in 11 of this section, Customer's Duties. You are solely responsible for sharing your social media account or phone number and are alone for the content you share in picture, word, or text form while doing so on our platform or any third-party application.
  9. The app is entitled to delete messages without asking at any time. For this reason, you are requested to call up the incoming messages and the data of your profile at regular and appropriate intervals and to archive them on your computer or other storage media if necessary.
  10. You further undertake not to misuse the service, in particular: Not to distribute immoral, obscene, nude, pornographic or radical political content or photos; to disseminate any defamatory, objectionable or otherwise illegal material or such information via the service; not to threaten, harass or violate any other person's rights (including personal rights); Not to use the app in a harmful or unauthentic way, in particular using services that change your natural IP address or location or disguise your true location, in particular when using VPN services while accessing the app; not upload any data that contains a virus (infected software) or software or other material that is protected by copyright, unless the customer has the rights to it or the required consent; not to use the service in a way that adversely affects the availability of offers for other customers; not to intercept emails / messages and not to try to intercept them; Sending emails / messages to customers for no other purpose than communication and in particular refraining from offering or offering goods or services to other customers (except in cases where this is expressly permitted by the app); no chain letters to send; not to send messages that serve a commercial purpose; not taking screenshots from profile pictures or text messages and sharing them with any other party outside the app without the user’s explicit consent; not to upload photos with text, advertisement or photos that are screenshots; not to upload photos what are regarded sexual, explicit, harassing etc: not to mention names, addresses, telephone numbers, email addresses, social media accounts or payment accounts etc. in the personal description.
  11. Failure to comply with one of the behavioral obligations mentioned in Section Customer's Duties 1 - 10 can lead to the following sanctions without prior warning: Request for comments in the event of a suspected breach of contract/law, blocking of use, up to the clarification of facts (especially in the case of several complaints from other customers), permanently blocked from accessing your account to use the app, warning, input/restrictions on the use of applications in the app’s services, partial and total deletion of your posted content in question.
  12. Failure to comply with the duties of conduct mentioned in Section Customer's Duties 10 can always lead to immediate termination of the user agreement and civil and criminal consequences for you. To keep its platform secure, the app has the right to terminate any account or block access if we determine this account of “high-risk” to the app.

Rights of Use and Copyrights

You agree that the app’s owner Jung Wei Hung, on Google Play and App Store, to publish the app is the sole legal owner of the reproduction, distribution, processing, and all copyrights and the right of intangible transmission and reproduction of the app and the individual content contained therein. The use of all programs and the content, materials, brand, and trade names contained therein are only permitted for the purposes stated in these terms and conditions. Thus, you will not violate Jung Wei Hung's intellectual property right of the App. You are legally liable to follow this rule regardless of whether you use any method to acquire the requirements or architecture of the app.

Billing, Payment, Subscriptions, and Memberships

The app enables paid online mentoring sessions through its booking management system via its iOS and Android apps. In this case, the conclusion of the contract, subscription, transaction, and revocation are processed via Apple and Google, respectively, and the technical specifications and principles established by these companies, over which the app has no influence. As a rule, a purchase is made via the iOS or the Android app. If the customer clicks on the "Confirm" field or a comparable field from Apple or Google’s payment platform for subscriptions, the app will not engage with the transactions or keep funds for you. This also applies to the one-time payment booking conducted through a third-party vendor, Stripe; therefore, your transaction process is subject to the vendor’s policy. The app does not influence it nor is it responsible for the user’s impact resulting from the vendor.

You can book a video session three times with a mentor on the app within a month (30 Days), however, once you reach the maximum of these free sessions within a month, you agree to either

    1. Wait another 30 days to book a new session 
    2. Or, pay a one-time booking fee, if not subscribing to the app 
    3. Or, subscribe to the app to waive the booking limit and be able to join a video call any time 

You can subscribe, update, or cancel any of the three subscription plans below:

  • Basic Plan (Monthly Subscription) with 13.99 USD per month
  • Premium Plan (3-month Subscription) with 34.99 USD per 3 months
  • Premium Plan (6-month subscription) with 54.99 USD per 6 months

By tapping the “Subscribe” button on the Subscription screen, you will be charged, your subscription will auto-renew for the same price and package length until you cancel it, and you agree to the app’s terms. The app is not responsible for transactions between the mentors and mentees.

The app’s one-time booking fee, and its subscription fees, are subject to the app and could change over time without notice.  

When you deactivate or delete your account, or if the account is suspended for violating the app’s terms, rules, or guidelines, you acknowledge that any remaining or unused membership will expire. No refunds will be issued for any remaining interest. If you deactivate your account and reactivate it later, you further agree that any remaining interest at the time of the account deactivation will not be reinstated and can be lost.

Applicable law, alternative dispute resolution

You agree that the app does not participate in dispute settlement procedures before consumer arbitration boards. In this respect, there is no legal obligation.

Disclaimers

  1. The app is not responsible for any incorrect content posted on the app or in connection with the service, regardless of whether it is caused by users of the app, members, devices, or programs connected to the service or used in this service.
  2. The app is not responsible for the online or offline behavior of a user of the app or a service member.
  3. The app is not responsible for errors, interruptions, deletions, defects, operating or transmission delays, communication line failure, theft or destruction, or unauthorized access to or changes in user or member communications.
  4. The app is not responsible for problems or technical malfunctions in telephone networks or lines, online computer systems, servers or providers, computer equipment, software, email, or player failure due to technical problems or traffic jams on the Internet or websites or a combination thereof, including injuries or damage to users or members or someone else's computer related to or resulting from participation or downloading of materials related to the website or service.
  5. In no event will the app be responsible for any loss or damage, including personal injury or death, arising from the use of the app or the service, content published on the app or transmitted to members, or interactions or contacts between users of the app, whether online or offline.
